About the NDIS Quality and Safeguards Commission
The NDIS Quality and Safeguards Commission (the Commission) is a regulator established on 1
July 2018 as an independent agency under section 181A of the _National Disability Insurance _

  • Scheme Act 2013_ (the NDIS Act) to improve the quality and safety of NDIS supports and
services. The Commission is the dedicated national regulator of NDIS service providers in
Australia.

During its formative phase, the Commission's focus was on establishing the essential systems
and processes needed to meet its legislated responsibilities. The Commission is transitioning
from "start-up" to the scale-up maturing of its operations to becoming an effective,
approachable and transparent regulator.

The NDIS Commission's core legislative functions
The Commission assists the Commissioner in the performance of her functions, the core of

which are to:
- uphold the rights of, and promote the health, safety and wellbeing of, people with

disability receiving supports or services, including those received under the National
Disability Insurance Scheme
- develop a nationally consistent approach to managing quality and safeguards for people

with disability receiving supports or services, including those received under the National
Disability Insurance Scheme
- promote the provision of advice, information, education and training to NDIS providers

and people with disability
- secure compliance with relevant legislation through effective compliance and

enforcement arrangements, including through the monitoring and investigation functions
conferred on the Commissioner by legislation
- promote continuous improvement amongst NDIS providers and their delivery of

progressively higher standards of supports and services to people with disability
- develop and oversee policy design for a nationally consistent framework relating to the

screening of workers involved in the provision of supports and services to people with
disability
- provide advice or recommendations to the National Disability Insurance Agency (NDIA)

and its Board in relation to the performance of the Agency's functions
- engage in, promote and coordinate the sharing of information to achieve the objects of

the relevant legislation
- provide NDIS market oversight, including:
i. monitoring changes in the NDIS market which may indicate emerging risk; and

ii. monitoring and mitigating the risks of unplanned service withdrawal


Legal Services and Internal Integrity Division
Our day-to-day work has a direct and immediate impact on the lives of people with
disabilities, which makes it incredibly meaningful, rewarding and fulfilling.

The Legal Services and Internal Integrity Division is comprised of the Legal Services Branch and
the Internal Integrity Unit. The Division is headed by the NDIS Commission's General Counsel.
While most of the Division's staff members are based in Parramatta, there are staff members
based in Melbourne, Adelaide, Brisbane, Canberra, Hobart and Perth.

The Internal Integrity Unit
The Internal Integrity Unit is responsible for the following functions:

  • co-ordinating internal reviews of decisions made by the NDIS Commission under the
  • National Disability Insurance Scheme Act _2013 (NDIS Act);
- managing the NDIS Commission's privacy function, including handling privacy inquiries,

privacy complaints and requests for access to and correction of personal information
under the
_Privacy Act _1988;
- processing requests for NDIS Commission documents under the _Freedom of _

  • Information Act _1982
_; _
- coordinating the handling of disclosures relating to the NDIS Commission in

accordance with the
_Public Interest Disclosure Act _2013;
- investigating and overseeing complaints made about the NDIS Commission's staff and

processes;
- coordinating the process for compliance by the NDIS Commission with its legislative

obligations; and
- capability building across the organisation, including providing education to

Commission staff.
