The Business Operations and Improvement Division is responsible for delivering essential customer-centric services and solutions that add value, help people get their job done and ensures DTP meets its compliance obligations.


About the Opportunity


The Prosecutor is responsible for the authorisation and prosecution of all summary offences in accordance with relevant legislation, departmental policies, guidelines and standards.

Reporting to the Manager, Prosecution and Case Review you will provide prosecutorial advice to teams across the branch and actively inform on policy and procedure in accordance with relevant legislation and best practice

Key outcomes include but are not limited to

  • Provide prosecution services to the highest standard. This includes examining evidence (in reports of alleged offences) and determining the appropriate legal action to be taken (in accordance with the relevant policies, guidelines and standards).
  • Attend various Magistrates' and Children's courts as a prosecutor and discharge all prosecutions in an efficient, professional manner.
  • Liaise with the accused person(s) and/or their legal representatives to achieve successful outcomes at court in accordance with the law and departmental policy.
  • Prosecute contested matters. This includes arranging and proofing witnesses, ensuring the department's responsibilities are discharged subsequent to any court decision and advising on the prospects of appeal (when/if applicable).

What we're looking for

  • Possess a sound understanding of legislation within the Victorian criminal jurisdiction (including rules of evidence, sentencing, bail and associated law).
  • Possess an understanding of public transport policy, and the regulatory and enforcement frameworks relating to public transport.
  • Demonstrated knowledge and experience in undertaking prosecutions and preparing briefs of evidence (to the highest standard) whilst ensuring compliance with all professional, ethical, and legal requirements.
  • Ability to present a case in an open court, utilising conflict management and negotiation skills.
  • Welldeveloped communication skills, with the ability to prepare and present comprehensive briefs and reports, as well as providing clear and practical enforcement and prosecution advice (within a complex operational framework).
  • High level of investigative, analytical and problemsolving skills that demonstrates the ability to evaluate situations and exercise sound judgment to make informed decisions.
Qualifications and Experience

Mandatory

  • Admitted to practice as an Australian Lawyer.
  • A current Legal Practising Certificate (or be eligible to obtain one).
Desirable

  • Other prosecution knowledge/experience.
