ABOUT THE ROLE
We have been

exclusively briefed by the Federal Court of Australia (FCA) to fill a National Registrar - Migration position which could be based in any of the following locations:

  • Sydney
  • Melbourne
  • Brisbane
  • Perth or
  • Adelaide
The FCA has jurisdiction in almost all civil (and some criminal matters) arising under Australian federal law.

The Court can hear cases in relation to admiralty, bankruptcy, competition, consumer protection, corporations, fair work, human rights, intellectual property and native title.

It also has the power to review some Federal Government decisions in areas such as social security, immigration, and taxation.


The Court has recently undertaken important reforms through the implementation of the National Court Framework, which underpins the way the Court will operate moving forward, through adopting a modernised approach to case management and operations to be better placed to meet litigant needs.


The reforms extend to registrar work, aiming to ensure an efficient effective and nationally consistent approach to allocation and management of work and to create opportunities for the career advancement and development of the Registrars.

The National Registrar - Migration is a multi-faceted position playing a key role within the reformed structure.


KEY DUTIES AND RESPONSIBILITIES:


  • Lead a team of lawyers responsible for reviewing and summarising all migration matters to assess their nature, urgency and complexity including any anomalies, competency issues, procedural history, potential cohorts, or specific case management requests.
  • Escalating case management issues to a Judicial Registrar or Judge as appropriate.
  • Working with another National Registrar to make recommendations in relation to appropriate allocation or reallocation of judicial work across both the FCA and FCFCOA having regards to judicial workload and availability considerations.
  • Supervising and coordinating the issue of case management directions in each matter
  • Running regular reports to monitor filing numbers and trends.
  • Maintaining records of allocations and listings
  • Assist the Judicial Registrars and Judges with ad hoc requests for caseload and statistical analysis, policy papers and reports for judges' meetings, and judicial committee meetings.
  • Preparing presentations and papers for meetings, seminars, and workshops.
  • Where appropriate, performing delegated judicial functions pursuant to the Federal Court of Australia Act 1976 (Cth) and other legislation instruments including in the areas of costs, mediations, and duty registrar practice.
  • Supporting the development of coherent and consistent practice and procedure including website material.

REQUIRED SKILLS AND EXPERIENCE

  • Experience in federal litigation, preferably in migration or administrative law and a sound knowledge of the available avenues of review in relation to migration decisions.
  • A sound understanding of case management principles.
  • Demonstrated experience and understanding, or ability to acquire such knowledge quickly, of the jurisdiction and practices and procedures of migration and other general federal law work in the FCA and the FCFCOA;
  • Demonstrated ability to critically evaluate large volumes of information and demonstrate sound judgment in decisionmaking.
  • Well developed communication skills, including the ability to work collaboratively, build and maintain positive professional relationships, deal appropriately with sensitive and confidential information and represent the Court externally.
  • Excellent analytical and conceptual skills and demonstrated achievements in developing and implementing improved and innovative services and processes.

FORMAL QUALIFICATIONS

must be admitted to the High Court and/or the Supreme Court of a State or Territory of Australia


This role would suit a lawyer with civil litigation experience in one or more areas of practice that align with the Court's NPAs, including preferably migration litigation experience.
