Overview of the Team and role


The team is primarily responsible for ensuring Comcare's compliance under various statutory processes including the _Freedom of Information Act 1982_ (FOI Act), the _Public Interest Disclosure Act 2013_ (PID Act), the _Privacy Act 1988 _and the _Ombudsman Act 1976_, and statutory reviews under the _Work Health and Safety Act 2011_ (WHS Act).


The Statutory Oversight team is responsible for:

  • Delivering Comcare's privacy function including actively promoting privacy, developing training, undertaking Privacy Impact Assessments and ensuring all Comcare activities are consistent with the Privacy Act;
  • Managing Comcare's freedom of information function including reviews and appeals and acting as Comcare's liaison with the Office of the Australian Information Commissioner;
  • Undertaking an integrity role including receiving Public Interest Disclosures (PID) and National Anti-Corruption Commission matters and coordinating PID investigations;
  • Acting as Comcare's liaison with the Commonwealth Ombudsman and preparing responses to their enquiries and investigations;
  • Assessing and reporting on Comcare's model litigant compliance;
  • Undertaking oversight functions including managing escalated complaints;
  • Managing Comcare's administrative release function.


Under supervision, the Legal Adviser supports the development of client-focused legal advice and support to Comcare staff including providing privacy and FOI advice and processing complex FOI and privacy requests.


The Legal Adviser will manage risk effectively and manage their workload in a manner consistent with the APS Values and Code of Conduct, the _Legal Services Directions 2017_, and internal Comcare procedures and guidelines.


Qualifications

  • Undergraduate degree in law.
  • Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory.
  • Current Practising Certificate or ability to obtain one within three months.
