Overview of the Team and role

The Regulatory Legal Team provides advice and support to Comcare's regulatory activities, including investigations under theWork Health and Safety Act 2011(WHS Act) and criminal prosecutions for alleged breaches of the WHS Act.

The team support the Regulatory Operations Group by:
providing advice and guidance on evidence gathering, the issuing of statutory notices and investigation procedures (investigations).
assisting with the preparation of briefs of evidence (prosecutions).
working closely with the Commonwealth Director of Public Prosecution and the Inspector when a prosecution is commenced.
facilitating continuous improvement projects and identifying trends and capability opportunities for inspectors.

As Principal Legal Adviser/Director you will provide strategic leadership for the Legal Group and lead the Regulatory Legal team to provide consistent, high quality legal services that manages legal risk for Comcare.

The Director will resolve problems and manage risk effectively.
They will manage their own workload autonomously while ensuring regular progress updates are available to the Executive.
The Director will achieve organisational objectives through successful planning and participating, contributing, and collaborating across Comcare.

The work includes:
providing advice on very complex WHS matters and investigations,
briefing the Enforcement Committee on prosecutions,
nurturing complex relationships with internal and external stakeholders,
collaborating with Regulatory Operations Group.

The Principal Legal Adviser will manage their own workload in a manner consistent with the APS Values and Code of Conduct, theLegal Services Directions 2017 , and internal Comcare procedures.

Mandatory Qualifications
Admission as a legal practitioner of the High Court or the Supreme Court of an Australian State or Territory.
Current unrestricted practising Certificate or ability to obtain one within three months.
Five years or more post admission experience as a legal practitioner.
Security Clearance
Ability to obtain and maintain a Baseline Security Clearance.
Specific Conditions
Some intra and interstate travel may be required, including overnight stays.
